Nectar Millionaire Draw - Terms and Conditions

These terms and conditions (“Terms and Conditions”) govern the relationship between Photobox (defined below) and participants in the Nectar and Photobox Millionaire Draw promotion (“Promotion”). All participants will be deemed to have agreed to and accepted these Terms and Conditions.

1. The Promotion Period

The Promotion will be open from 00:00:01 on 13th February 2017 BST and will end at 23:59:59 on March 22nd 2017 BST (“Promotion Period”). The Promotion is for a Prize Draw that consists of: • one (1) prize draw for the Million Nectar Points prize (the “Million Points Prize”); and • one (1) prize draw for fifty (50) Runner up prizes (“Runners Up Prizes”), each winning £50 Photobox credit

2. Who can enter?

The Promotion is open to residents of the United Kingdom that, at the start of the Promotion Period, are aged 18 years or over, and that are registered on www.photobox.co.uk (“Site”). Participants must have linked Nectar and Photobox accounts during or before the Promotion Period. Employees (and their families) of Photobox Limited (“Photobox”), Aimia Coalition Loyalty UK Limited (“Aimia”), or of any affiliates or subsidiary companies of Photobox or Aimia, any representatives or agents of those companies, and anyone else who may be directly involved with the Promotion in a professional capacity, are ineligible for the Promotion.

3. How to enter and Rules of Entry

To be entered into a Prize Draw, participants must do the following:

a) Register or log in to Photobox and link their Nectar account to their Photobox.co.uk account – this will act as one entry. Any subsequent linking of the same Nectar account will not count as an entry. However, any eligible Photobox account that has been matched to a Nectar account before the commencement of the Promotion Period will also be entered in the Prize Draw automatically.

b) To gain a further entry in the Prize Draw, using the Photobox account that has been matched to a Nectar account during the Promotional Period make a purchase on the Site that you can normally earn Nectar points on (“Eligible Purchase(s)”). These purchases will each act as another entry into the Prize Draw. The Prize Draw for both the main Million Points Prize and the Runner’s Up Prizes will be held on March 26th 2017. If a participant makes multiple Eligible Purchases, they will be entered once per purchase into the Prize Draw. Only completed purchases for which payment in full is received by Photobox, and that are not returned or otherwise cancelled, qualify as Eligible Purchases. Photobox reserves the right to eliminate from the Prize Draw purchases that do not satisfy this requirement. Participants will not receive confirmation of their entry into a Prize Draw or Prize Draws. If the eligibility criteria are satisfied and the correct entry procedures are followed, participants will be entered automatically.

4. Winners Selection

There will be one (1) winner for the Million Points Prize. The winner will be the first entry selected at random from the pool of entries automatically generated for the Prize Draw. There will be fifty (50) winners for the Runners Up Prizes. The winners will be the first fifty entries selected at random from the pool of entries automatically generated for the Prize Draw.

5. Winner Notification

Winners may be notified via e-mail or phone March 26th and April 9th] using the contact details provided by them in their Photobox or Nectar account. Participants are responsible for ensuring that the contact details present in their Photobox and Nectar accounts are accurate, complete and up-to-date including, but not limited to, their postal address and county.

Photobox reserve the right to verify the eligibility of any participants and/or entries.

6. What will you win?

There will be one (1) Million Points Prize. This prize is one million Nectar points that will be credited to the Nectar account that is linked to the Photobox account of the winner within 30 days after the end of the Promotion Period. There will be fifty (50) Runners Up Prizes. These prizes are £50 Photobox credit and will be credited to the Photobox account of the winner within 30 days after the end of the Promotion Period. The credit will be valid for purchases on the Site and will expire on March 31st 2018. If, for any reason, the Nectar accounts of the winners are unable to be credited with the Million Points Prize (e.g. – if it is blocked or suspended), they will cease to be entitled to the Million Points Prize and a new winner will be selected in accordance with condition 4 above. If, for any reason, the Photobox accounts of the winners are unable to be credited with the Runners Up Prizes (e.g. – if it is blocked or suspended), they will cease to be entitled to the credit and a new winner will be selected in accordance with condition 4 above The Million Points Prize and Runners Up Prizes are not substitutable or transferable by the winner and there is no cash alternative to any of them. Only one Million Points Prize or Runners Up Prize per entrant will be awarded in accordance with condition 4 above: entrants can only be a winner once.

7. Exclusion From Participation

Any attempt to manipulate, influence or affect the Promotion in any way is prohibited and will result in exclusion from participation. If Photobox has suspicions or knowledge that any participant has been involved in any fraudulent or illegal activity, Photobox reserves the right to disqualify that participant and any related participants. Photobox may also disqualify any participant that does not act in accordance with these Terms and Conditions (or is acting in a way that contravenes the spirit and intention of these Terms and Conditions) or Photobox’s User Agreement, the Nectar programme terms and conditions, and/or any other policies or terms and conditions that Photobox may communicate to you. Participants whose Nectar account is blocked, closed or restricted or whose account becomes blocked, closed or restricted for any reason during the Promotion Period are or will be excluded from participating in the Promotion.

8. Data Use, Data Privacy Protection

By accepting the Million Points Prize or Runner’s Up Prizes, the winners will consent to their name (and, where known, county) being made available on the photobox.co.uk Facebook page and/or Twitter feed and/or upon request. If you do not agree to this, you must not accept the Million Points Prize or Runners Up Prize, as the case may be. The use of any other information about you for promotional or advertising purposes will require your consent. The draws for the Million Points Prize and the Runners Up Prizes will be conducted by Aimia under Photobox’s direction. In order to facilitate this, participants’ Photobox member IDs and the date on which they linked their Photobox and Nectar accounts will be sent to Aimia, and used by Aimia solely for the purpose of conducting the draws.

9. General

Photobox reserves the right to suspend, change or cancel this Promotion at any time, in the event of circumstances arising which in Photobox’s reasonable opinion make it necessary for it to do so. Photobox reserves the right to vary these Terms and Conditions where in Photobox’s reasonable opinion it is necessary to do so. This includes the ability to substitute or replace the Prize(s) with an alternative/alternatives that is/are, in Photobox’s reasonable opinion, of equivalent value, to change the specification of the Prize(s) if circumstances require it or to change the entry procedure. No correspondence will be entered into by Photobox in relation to the Promotion. Photobox may use third parties to facilitate one or more elements of the Promotion. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced Photobox-related operation. The Prize Draws will be carried out and administered by Photobox. These Terms and Conditions are governed by the law of England and Wales. Photobox and participants irrevocably agree to the non-exclusive jurisdiction of the English courts over any claim or matter arising in connection with these Terms and Conditions and/or the Promotion. The Promotion is organised by Photobox Limited of Unit 7 30 Great Guildford Street, London, SE1 0HS. Certain elements of the Promotion, including the selection of the winners of the Million Points Prize and the Runners Up Prizes and notification of the winner of the Million Points Prize, and crediting of the Million Points Prize to the winner’s Nectar account, will be performed by Aimia Coalition Loyalty UK Limited, of 6th Floor, 80 Strand, London WC2R 0NN.
